Miami Racket Club Terms and Conditions

 

These Terms and Conditions govern your access to Miami Racket Club, including membership, events, programs, digital content, and website use. By joining, participating, or using the site, you agree to all policies outlined below.

 

 

1. Membership Agreement

 

Memberships are offered on a twelve month term. By enrolling, you agree to maintain your membership for the full duration of the term and to pay all associated dues.

 

 

Early Termination

 

If you cancel before your term ends, you will be charged an early termination fee equal to the prorated remainder of the plan. All remaining fees become immediately due.

 

 

Payment Authorization

 

By completing checkout and checking the authorization box, you authorize Miami Racket Club to charge the payment method on file for recurring dues, unpaid balances, early termination amounts, and any other fees owed under this agreement until fully paid.

 

 

Automatic Renewal

 

After your initial twelve month term, your membership will renew on a month to month basis unless you cancel in writing at least thirty days before the next billing date.

 

 

Payment Failures

 

If a payment fails, you will be notified and given a short grace period to update your payment information. If payment is not resolved, your membership may be suspended until the account is current.

 

 

Past Due Accounts

 

Accounts unpaid for more than forty five days may be suspended and referred to a third party billing or collections partner. You are responsible for any reasonable costs associated with the recovery of unpaid balances.

 

 

Holds and Pauses

 

You may place your membership on hold for up to sixty days at one time and no more than ninety days total in any rolling twelve month period. Your term will be extended by the length of any hold.

 

 

Non Refundability

 

All dues, fees, initiation amounts, early termination charges, event fees, and add-on purchases are non refundable.

 

 

Non Transferability

 

Memberships may not be shared, transferred, or assigned to another person.

 

 

Contact Information

 

You are responsible for keeping your email address and payment method on file up to date. All official notices will be sent to the email address you provide.

 

 

2. Member Conduct

 

Members are expected to uphold the values, culture, and community standards of Miami Racket Club at all events, programs, digital spaces, and partner venues. Conduct that harms the club experience, staff, community, or brand may result in suspension or revocation of membership. Revoked memberships are not eligible for refunds.

 

 

3. Event Policies

 

Event dates, times, and formats may change. Miami Racket Club reserves the right to modify or cancel events at any time. Certain events may have separate registration fees or attendance limits. Some events may be photographed or filmed.

 

 

Event Attendance

 

Members must follow all event rules, etiquette, and safety guidelines. Miami Racket Club may remove any attendee who disrupts events or behaves inappropriately.

 

 

No Guarantee of Access

 

Events may have limited capacity. Registration does not guarantee access if capacity is reached.

 

 

4. Waiver and Release of Liability

 

Participation in tennis, fitness, athletic programs, and related activities carries inherent risks. By participating, you acknowledge these risks and voluntarily assume them.

 

You release Miami Racket Club, its owners, staff, partners, and affiliates from liability for injuries, accidents, property damage, or losses arising from participation in any club activity or event, except where prohibited by law.

 

This release applies to all MRC activities including tennis, clinics, workouts, matches, events, off-site gatherings, and recreational play.

 

 

5. Photography and Media

 

By attending events or participating in club activities, you grant Miami Racket Club permission to use your image, likeness, voice, and appearance in photos, videos, film, and promotional materials without compensation.

 

You may request removal of content from future use by contacting the club, although removal of previously published content cannot be guaranteed.

 

 

6. Website Terms of Use

 

Your use of the MRC website is subject to the following:

 

 

Acceptable Use

 

You may not use the site for unlawful purposes, attempts to gain unauthorized access, or conduct that disrupts or damages the site.

 

 

Intellectual Property

 

All content, imagery, design elements, logos, branding, trademarks, and written materials are owned by Miami Racket Club and protected by law. You may not copy, reproduce, distribute, or modify any content without written permission.

 

 

Third Party Links

 

The site may contain links to external websites. These links do not imply endorsement. MRC is not responsible for the content or practices of third party sites.

 

 

Termination of Site Access

 

MRC may suspend or terminate access to the site at any time for misuse or violation of these terms.

 

 

7. Privacy

 

Miami Racket Club collects and stores certain information to deliver services including membership management, payment processing, event communication, and community operations. Your information is handled in accordance with our Privacy Policy.

 

By joining or using the website, you consent to receiving email communications related to your membership, billing, and MRC events and updates.

 

 

8. Chargebacks

 

You agree to contact Miami Racket Club directly with any billing concerns before initiating a chargeback. Filing a chargeback without first contacting the club may result in temporary suspension of membership privileges.

 

 

9. Legal Terms

 

 

Governing Law

 

These Terms and Conditions are governed by the laws of the State of Florida.

 

 

Dispute Resolution

 

Any disputes arising out of or related to your membership, participation, or use of the site will be resolved through binding arbitration rather than court. You waive the right to participate in class actions.

 

 

Indemnification

 

You agree to indemnify and hold Miami Racket Club harmless from claims, damages, losses, or expenses arising from your actions, misuse of the site, violation of these terms, or participation in MRC activities.

 

 

Entire Agreement

 

These Terms constitute the complete understanding between you and Miami Racket Club regarding membership and site use and supersede all prior agreements.
